Amends constitution: requires refunding general fund revenues exceeding state estimates to taxpayers.

RESULT OF "YES" VOTE: "Yes" vote establishes constitutional requirement to refund general fund revenues exceeding state estimates to taxpayers.

RESULT OF "NO" VOTE: "No" vote rejects constitutional requirement to refund general fund revenues exceeding state estimates to taxpayers.

PEAPAC Explanation: If passed, Measure 86 would put Oregon’s so-called “Kicker Law” into the State Constitution, taking away the ability of the Legislature to spend the “kicker.”

In 1979, the Oregon Legislature passed the “Kicker Law.” When income tax collections exceed the state’s estimates by 2 percent or more, the excess must be returned, “kicked” back, to taxpayers. But the Legislature can bypass the law by voting to spend the money. This Measure would put the kicker law into the Constitution, totally removing the ability of the Legislature to spend it.

We support this Measure for the same reasons we are supporting all Measures aimed at reducing taxes. For our reasons, see our sidebar “The Bible, Taxation and Whiskey.” We urge you to vote yes on Measure 86.
